1. Purpose of This Agreement
This agreement explains how any legal dispute related to massage therapy services will be resolved. By signing below, both the client and the massage therapist agree to use binding arbitration instead of going to court.
2. Agreement to Arbitrate
Any dispute, claim, or disagreement arising from or related to massage therapy services—including but not limited to personal injury, professional negligence, billing issues, or consent—will be resolved exclusively through binding arbitration.
This applies to:
Services already provided
Services currently being provided
Services provided in the future
3. What Arbitration Means
Arbitration is a private legal process where:
A neutral arbitrator (not a judge or jury) decides the dispute
The decision of the arbitrator is final and legally binding
Both parties give up the right to a jury trial or to have the dispute heard in court
4. Arbitration Process
Arbitration will be conducted by a mutually agreed-upon arbitrator or arbitration service
Arbitration will take place in the state where the massage services are provided, unless both parties agree otherwise
Each party may have legal representation at their own expense
Arbitration fees will be shared equally unless the arbitrator decides otherwise
5. Scope of Agreement
This agreement covers:
Claims of negligence or malpractice
Claims related to consent, boundaries, or professional conduct
Claims related to payment, refunds, or services rendered
This agreement does not prevent either party from filing a complaint with a state licensing board or regulatory agency.
6. Voluntary Agreement
By signing below, the client confirms:
They have read and understand this agreement
They understand they are waiving the right to sue in court or have a jury trial
They have had the opportunity to ask questions before signing
They are signing this agreement voluntarily
7. Severability
If any part of this agreement is found to be invalid or unenforceable, the remaining sections will still remain in full effect.
8. Entire Agreement
This document represents the full arbitration agreement between the client and the massage therapist and applies to all massage therapy services unless replaced by a written agreement signed by both parties.
